In the new FDA Menu Labeling draft guidance documents released yesterday by the FDA, the word flexibility is used 9 times throughout the 36 page document, however little has changed following the 1,000+ comments submitted to the department over the summer in response to the compliance delay. August 28, 2017 ​ALEXANDRIA, Va. – On Friday, NACS announced the lawsuit to prevent New York City from enforcing its menu-labeling regulations prior to the compliance date set by the U.S. Food and Drug Administration (FDA) has been settled. NACS filed the lawsuit, along with the New York Association of Convenience Stores (NYACS), the Food Marketing Institute (FMI), and the Restaurant Law Center, in July. Many industry groups and retailers were pleased to see The Common Sense Nutrition Disclosure Act (introduced to the House Energy and Commerce Committee in January) pass a Committee vote with bipartisan support.  The HR772 bill  will now be advanced for a full House vote and has the support from industry groups such as NACS, NAG and FMI.
